ESTROME DAP LEGAL
Terms of Service
These Terms govern access to Estrome DAP, a business asset-management and digital asset passport service supplied by Estrome Technologies (OPC) Private Limited (“Estrome”, “we”, “us”). By accepting these Terms for an organisation, you confirm that you are authorised to bind that organisation (“Customer”).
1. Service And Account
DAP provides asset records, lifecycle workflows, reports, integrations and related administrative functions according to the subscribed plan. The Customer must provide accurate registration and billing information, protect administrator credentials, enable required security controls and ensure that authorised users comply with these Terms.
2. Permitted Use
The Customer may use DAP for its lawful internal business operations. It must not misuse the service, probe or bypass security, introduce malicious code, access another customer’s data, resell access without written approval, or use DAP in violation of applicable law or third-party rights.
3. Customer Data
The Customer retains ownership of content and records it submits. The Customer authorises Estrome and its contracted processors to host, process, secure, back up and transmit that data only as needed to provide, protect and support DAP. The Customer is responsible for having lawful authority to upload personal, asset and supplier information.
4. Security And Availability
Estrome uses technical and organisational safeguards, tenant isolation, access controls, audit records, malware screening and backups. No internet service can be guaranteed uninterrupted or error-free. Planned maintenance, emergency security work and circumstances beyond reasonable control may affect availability.
5. Intellectual Property
DAP, its software, designs, documentation and branding remain the property of Estrome or its licensors. Except for the subscribed right to use DAP, no intellectual-property rights are transferred.
6. Third-Party Services
Integrations such as payment gateways, maps, cloud services and device-management connectors may be governed by their providers’ terms. Estrome is not responsible for a third party’s independent systems, but remains responsible for its own contractual obligations.
7. Suspension And Termination
Estrome may restrict access for material breach, non-payment, fraud, security risk or unlawful use, with notice where reasonably possible. On termination, access ends and Customer data is retained or deleted according to the Privacy Policy, applicable law and any agreed export period.
8. Warranty And Liability
DAP supports operational decision-making but does not replace professional, legal, tax, accounting, safety or regulatory advice. To the extent permitted by law, Estrome’s aggregate liability arising from the service is limited to fees paid for DAP during the six months preceding the event giving rise to the claim. This limitation does not exclude liability that cannot lawfully be excluded.
9. Changes
Material changes will be published with a new version and effective date. Where required, Estrome will request renewed acceptance before continued paid use.
10. Governing Law
These Terms are governed by the laws of India. Subject to any mandatory dispute forum or consumer right, courts at Lucknow, Uttar Pradesh have jurisdiction. The parties should first attempt good-faith resolution through info@estrome.com.
